Terms and Conditions of Participation
1. Organizer
The organizer of the giveaway is Relaxound GmbH, Wilhelm-von-Siemens-Straße 12-14, 12277 Berlin, represented by the managing directors Philipp Störring and Dennis Clasen (hereinafter referred to as "Relaxound"). The giveaway is conducted through the online shop Relaxound.com (hereinafter referred to as the "Shop"). Relaxound offers the giveaway in its own name and for its own purposes.
2. Eligibility
Eligible participants are natural persons who have reached the age of 18 at the time of participation and have a residence in the Federal Republic of Germany. Another condition of participation is that the participant has made a purchase in the Shop through which the giveaway is conducted. Employees and other staff members of Relaxound, as well as all persons involved in the implementation of the giveaway on behalf of the organizer, are excluded from participation. Each participant is only allowed to participate once in the giveaway.
Multiple participation or participation through multiple accounts in the Shop is not permitted. Relaxound reserves the right to exclude participants who violate this regulation. Relaxound also reserves the right to exclude persons from participating in the giveaway if, considering the participant’s legitimate interests, there are justified reasons for doing so. A justified reason exists in particular in the case of manipulation of access or execution of the giveaway, serious violations of these terms and conditions, and incorrect or misleading information provided during participation in the giveaway.
3. Conditions of Participation
To participate in the giveaway, a purchase must be made in the Shop.
4. Costs
Participation depends on the purchase of a Relaxound soundbox. Any shipping costs for the prizes will be covered by Relaxound. Winners are responsible for any applicable taxes on the prize.
5. Duration
The giveaway takes place from March 21 to March 31, 2025. Participation requests received after this period will not be considered.
6. Prizes
The prizes announced in the Shop will be awarded. A cash payment equivalent to the prize value is excluded.
7. Selection of Winners
The winners will be determined immediately after the participation period ends. The selection will be carried out through a random draw among all eligible participants who meet the participation requirements.
8. Notification of Winners
Winners will be informed via a personal, non-public email message and asked to provide the necessary details for prize delivery to Relaxound. If the winner does not respond despite repeated notifications and requests to submit the required information within three business days per request, Relaxound reserves the right to reallocate the prize through another draw.
9. Prize Shipping
The prize will be sent to the postal address provided by the participant to Relaxound. If delivery to the specified postal address is not possible, there is no entitlement to a reshipment. The prize claim will expire.
10. Modification or Early Termination of the Giveaway
Relaxound reserves the right to modify or terminate the giveaway early if, considering the participant's legitimate interests, there are justified reasons for doing so. A justified reason exists particularly if there is credible evidence of manipulation of the giveaway by participants or third parties or if a lawful execution of the giveaway cannot be ensured for technical or legal reasons.
11. Data Protection
The collection of participants’ personal data is based on Article 6(1)(b) of the General Data Protection Regulation (GDPR). Data processing is conducted solely for the execution of the giveaway and, if necessary, for the distribution of prizes. Any data not required for this purpose will not be collected. All participant data will be deleted immediately after the giveaway ends and, if applicable, after prize distribution. This does not apply if Relaxound is legally obliged to retain personal data for tax or commercial law reasons. In such cases, the data will be retained exclusively for compliance with these obligations. Personal data will not be shared with third parties, except for forwarding to a shipping company involved in prize distribution. Participants have the right to:
- Request information about the processing of their personal data (Article 15 GDPR),
- Request correction of their personal data (Article 16 GDPR),
- Request deletion of their personal data (Article 17 GDPR),
- Request restriction of processing (Article 18 GDPR),
- and Request data portability (Article 20 GDPR).
The responsible supervisory authority is the Berlin Commissioner for Data Protection and Freedom of Information. Participants have the right to file a complaint at any time.
12. Participant’s Responsibility on Social Media Platforms
Participants agree not to publish any unlawful content within the framework of the giveaway. This particularly includes, but is not limited to, content that violates criminal law or infringes third-party rights. Participants shall indemnify Relaxound against any third-party claims arising from violations of this obligation.
13. Legal Recourse
Legal recourse is excluded.
14. Consumer Dispute Resolution
Relaxound does not participate in dispute resolution procedures before a consumer arbitration board.
15. Disclaimer
The giveaway is in no way sponsored, supported, or organized by any social media platform. The sole contact person and responsible party is Relaxound. Participants do not have any claims against the social media platform by participating in the giveaway.
16. Applicable Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
